THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
This Notice of Privacy Practices applies to all protected health information ("PHI") created, received, maintained, or transmitted by MSC Wound Care, PLLC, its employees and workforce members ("we," "our," and "us"). Your PHI is protected by federal law, including HIPAA. We are required by law to provide you with this Notice.
1. How We May Use and Disclose Your Health Information
1.1 Treatment: We may use and disclose your PHI to provide, coordinate, or manage your healthcare and related services, including sharing information with physicians, nurses, specialists, and other members of your care team.
1.2 Payment: We may use and disclose your PHI to obtain payment for services, including submitting claims to your health plan, verifying eligibility and benefits, and obtaining prior authorizations.
1.3 Healthcare Operations: We may use and disclose your PHI for quality assessment, workforce training, accreditation, compliance audits, business planning, and general administrative activities.
1.4 Health Information Exchanges: We may participate in health information exchanges (HIEs) and share your PHI electronically for treatment, payment, and healthcare operations unless you opt out.
1.5 Business Associates: We may disclose PHI to vendors and service providers that perform functions on our behalf. All business associates are required to protect your information under a Business Associate Agreement.
1.6 Required by Law: We may use and disclose your PHI when required by applicable law, including disclosures to the U.S. Department of Health and Human Services.
1.7 Public Health Activities: We may disclose your PHI to public health authorities for preventing or controlling disease, injury, or disability.
1.8 Health Oversight Activities: We may disclose PHI to health oversight agencies for audits, investigations, and inspections authorized by law.
1.9 Judicial and Administrative Proceedings: We may disclose your PHI in response to a court order, subpoena, or other lawful process.
1.10 Law Enforcement: We may disclose PHI to law enforcement officials for limited purposes such as complying with a court order or reporting a crime on our premises.
1.11 Serious Threats to Health or Safety: We may use or disclose PHI when necessary to prevent a serious and imminent threat to health or safety.
1.12 Other Permitted Uses: We may also disclose PHI in connection with decedents/organ donation, workers' compensation, abuse or neglect reporting, research (subject to applicable law), and specialized government functions.
2. Uses and Disclosures That Require Your Authorization
The following uses require your written authorization: psychotherapy notes, marketing purposes, sale of PHI, and any other use not described in this Notice. You may revoke a written authorization at any time by submitting a written request to us.
3. Your Rights Regarding Your Health Information
Right to Inspect and Copy: You have the right to inspect and obtain a copy of your PHI. We will respond within 30 days and may charge a reasonable fee for copies.
Right to Request Amendment: You may request that we amend PHI you believe is incorrect or incomplete. We will respond within 60 days.
Right to an Accounting of Disclosures: You may request a list of certain disclosures we have made of your PHI in the six years prior to your request.
Right to Request Restrictions: You may request restrictions on certain uses and disclosures of your PHI.
Right to Confidential Communications: You may request that we communicate with you in a certain way or at a certain location.
Right to a Paper Copy: You have the right to obtain a paper copy of this Notice at any time.
Right to Be Notified of a Breach: You have the right to be notified in the event of a breach of your unsecured PHI.
4. Our Duties
We are required by law to maintain the privacy and security of your PHI, provide you with this Notice, abide by its terms, and notify you following a breach of your unsecured PHI. We reserve the right to change this Notice at any time.
5. How to File a Complaint / Ask Questions
If you believe your privacy rights have been violated, you may file a complaint with us or with the U.S. Secretary of Health and Human Services. We will not retaliate against you for filing a complaint.

6. State Law and Additional Protections
When subject to federal and state laws stricter than HIPAA — including laws relating to mental health, substance use disorder, HIV/AIDS, reproductive health, or genetic information — we comply with those stricter requirements.
